In a brief meeting on Thursday, December 2, the Stephentown Zoning Board of Appeals (ZBA) voted to take lead agency status in the State Environmental Quality Review (SEQR) process regarding a revised application from Howard Commander to build a Motocross sports park off of Webster Hill Road. The Board also voted to contact all interested and involved agencies requesting consent to this action.
Present at the meeting were a representative of Clough Harbour, the engineering firm the ZBA has hired to advise them in the matter, and Craig Crist, of the law firm Dreyer Boyajian, who will guide the Board with legal advice. The engineering and legal fees will be paid by the applicant.
Commander has submitted a revised application for a zoning variance and a revised Environmental Assessment Form. Board Member Roland Barth questioned the lack of a land survey in the application. Commander’s attorney, Francis J. Roche of Hudson, agreed to provide one.
According to Crist, the application has not been accepted as complete yet by the ZBA. They will continue to review the application and are likely to rule on its completeness at their next meeting scheduled for Thursday, January 6, at 7 pm.
