Motion To Dismiss Is Granted In Higgins Case

A complaint filed by former Grafton Supervisor Frank Higgins against Catherine Goyer, Michael Crandall, Richard Ungaro and the Town of Grafton for malicious prosecution and defamation was dismissed in a decision released January 26, written by Rensselaer County Supreme Court Justice Patrick McGrath.[private]

The dispute came out of an incident in February 2015 in which Goyer attempted to enter Higgins’ office when he had asked her not to. Goyer alleged that Higgins was violent, which led to a trial in Brunswick Town Court in which Higgins was found not guilty.

Higgins then filed a complaint alleging malicious prosecution and defamation.

Thomas Murphy, attorney for Goyer, Crandall and Ungaro, filed a Motion to Dismiss on behalf of the three of them at the beginning of December, and that motion has now been granted, dismissing all of Higgins’ claims against the three of them.

It is not clear yet if this is the end of the matter or if there will be further litigation about this. [/private]
